And where as it has been stipulated by you in the said Contract that the Contractor shall furnish you with a bank guarantee for a sum amount to 10% (ten percent) of Contract value.
At the request of the Contractor, we, the undersigned Bank of China Limited, Shaanxi Branch, No. 246 Dongxin Street, Xi′an, China, hereby irrevocably and unconditionally undertake to pay you any sum or sums not exceeding in aggregated an amount of EUR13,300.00 (Say Euro thirteen thousand three hundred only) upon our receipt of your first writeen demand declaring the contractor is in breach of its obligation(s) under the Contract.
The guarantee shall come into force upon the Contractor′s receipt of EUR13,300.00 at its account No. 1002 2198 6636 held with Bank of China Limited, Shannxi Branch and will be valid until July 19th, 2000 (hereinafter called ‘the Expiry Date′). It remains in force and effect also if there is a change in the respective ownership or if there is a change in the legal structure of the Contractor. Any demand for payment must reach us on or before July 19th, 2000. Upon expiry, this guarantee will be cancelled automatically, whether the original is returned or not.
承包商自在其中国银行陕西分行1002 2198 6636账号中收到13300欧元时该保函生效，于2000年7月19日（此后称‘有效期′）到期。该保函在各自所有权变更或承包商法律结构变更时仍然有效。须在2000年7月19日之前递交我方任何付款要求。到期后，无论是否归还该原件，本保函自动解除。
This guarantee is subject to the law of Federal Republic of Germany. The place of jurisdication shall be Duesseldorf.
This guarantee is not transferable.
